Complementary wills

Recently, the Court of Appeals from Ceará, in Brazil, had discuss a matter involving a dispute between heirs which were contemplated in two different wills.


While part of the heirs wanted to have their rights recognized, the others alleged that one of the wills had been revoked.


The final decision of the Court considered the compatibility and possibility of the existence of complementary wills, therefore the provisions of the last will upon both groups of heirs was applicable.


Although the decision was positive, it demonstrates that an inappropriate estate planning can result in long and public disputes. Consequently, it is essential to make a complete and centralized estate planning, which includes all the testator's intentions, watching all the legal biases and avoiding risks of disputes and judicialization.
